Travel ban and arms embargo
Though great importance has been attached to limiting the mobility of the designated individuals, countries have been lax about imposing the mandatory travel ban. Many names on the list are not being included in domestic watch/stop list owing to lack of adequate identifiers and quite strict judicial requirements in individual states. In some cases, officials responsible for implementation of the travel ban may decide that all the names in the list need not be included in the national watch list because they consider it unlikely that certain listed persons would travel to a particular country. Even in cases where all the names in the list are included in the watch list, some names or aliases may not alert a border control point because they are mentioned incorrectly.118 Thus designated persons often travel freely. Ahmed Ali Yusuf, a Swiss national, regularly travelled throughout Europe, and to the Middle East and Africa while under designation. He was on the Consolidated List under the surname âYusafâ instead of his actual name. The new passport he received in 2004 contained a number different from the document number for him on the list, which was not updated.119
Moreover, lack of capacity, especially lack of ability to access information electronically, has prevented some states from enforcing strict controls against the movement of these individuals, especially at busy border crossings or entry points.120 In areas such as Afghanistan, Iraq and Somalia, where there is no effective border control, it is impossible to implement the travel ban and to be sure whether or not listed individuals have travelled.121 Thus the travel ban has come to have little value except as a âpolitical statement.â122
Similarly, arms embargo is found to be the most difficult component of the sanctions regime to enforce and monitor. States do not have a sound understanding of the importance of the embargo and of what is expected of them to enforce it. They are generally unwilling to disclose or share any information on this subject owing to national security concerns. Moreover, absence of a specific legal framework in a number of states undermines the role, efficiency and objectives of the embargo and makes it easier for individuals and entities on the list to continue to operate, as they want.123
